A killer is a person who intentionally does things that result in the desired death of one or more persons (excluding suicide). (Wordnet definition: 'someone who causes the death of a person or animal'.)
His involvement in the murders, his 'art' of picking up and brainwashing people that were susceptible to his ideas was proven over and over during the 1970 trial.
Taking these two concepts/facts together, there is no logical way not to call CM a murderer/killer. Without his involvement, the atrocities would NOT have taken place. And if you REALLY listen to him in any of his interviews, you will realize that he has, still is and for the rest of his life will play mind games trying to imprint his ideas into other people's minds.

Just to make the point: if somebody orders a murder, e.g. in the mafia, but does not commit it himself, that person is suspect to murder (1st degree) charges.
