Warner has every right to prevent anyone other than Green Day (and their label) to profit from 'smashes'. Smashes are samples, the law is clear on this. Since, it appears, that Dean Gray is not doing mixes to make money then he should be in the clear... maybe even praised by Warner for helping indirectly 'market' the band. Copyright law is really simple... if someone made something that someone else used or sampled to make money then the person who started it all gets a piece of the action - if it wasn't pre-negotiated then expect to see lawsuits. It's called 'credit where credit is due' and if you've ever created something you appreciate people looking after it for you.
