"The View's US immigration problems explained: singer on drugs charge?"

"As reported earlier this month, Scottish quartet The View were forced to cancel a series of shows in the US and Canada after the band fell foul of the States' immigration rules. The exact hows and whys weren't revealed at the time, but now it's come to light that the band's singer, Kyle Falconer, is apparently facing a drugs charge." [Drowned in Sound]

As someone who has worked both in an immigration law firm and a student visa office, I would say that Kyle Falconer is not yet in hot water.
His arrest and subsequent charge for cocaine posession certainly forced him to withdraw his visa application for a tour (NOTE: While EU citizens do not need a visa to visit the United States, it is always necessary get a short term work visa if you are on tour or have a job).

If he is found guilty, he will have to report this on future visa applications. If found not guilty, well that's where I'm not sure. My knowledge of UK Common Law is not so good.

Ultimately it depends on the sucess of his band. The group being fined for trashing a hotel may not look so good for them. But if they are sucessful enough, have a large enough US following to warrant them going on tour and have a good lawyer/representation, then it's on. If not, off to the $4 bin with you.

US immigration has been a concern of mine for quite some time. I am American and my wife is from Venezuela... so I am very familiar with the racial profiling that occurs when crossing US Borders. This country is far from being the "land of the free". I created a 5 minute short film that deals with the anxiety and frustration created when passing through US Customs.
