Post-punk pioneers Devo say they are suing McDonald's in the US over a Happy Meal doll that sports the band's signature red flower pot hat.

In April the fast food chain released a series of American Idol Happy Meal toys in the US based on a range of music genres, including Disco Dave, Country Clay, Rockin' Riley and Soulful Selma.

Devo's complaint relates to New Wave Nigel, a toy kitted out in an orange jumpsuit, pink shades, and Devo's "energy dome" hat.

The band also allege that the toy plays a "Devo-esque song". []

Devo, Tom Tom Club and Dan Deacon are playing McCarren Pool in Brooklyn this Thursday June 26th (6:00PM Doors/ 6:30PM Show). Tickets are still on sale, or you can try to win one of FIVE PAIRS I have to give away.....

TO WIN E-mail BVCONTESTS@HOTMAIL.COM (subject: Devo). Include your full name, and tell us the name of the festival that Devo just played in Barcelona and the name of the festival Dan Deacon just played in Philly. Five winners will be picked and contacted by end of day Wednesday.

Thanks to Musebox for the contest.

And just to be 100% clear...the show is at:

Williamsburg, Brooklyn
At Lorimer Street - Driggs Ave & Bayard St.

6:00PM Doors/ 6:30PM Show

I assume that means that Dan Deacon will go on sat 6:30 sharp.

Good luck.

Is it going to be sold out before Thursday? I want to go, but don't wanna pay the extra $ 11.75 to Ticketmaster for "convenience charge", so I'm hoping it's going to be possible to buy them at McCarren?

Does anyone know if the show will still be scheduled if it is raining?

Posted by chud | June 26, 2008 10:31 AM

Ticketmaster says rain or shine so I assume it will still be on.

Posted by Anonymous | June 26, 2008 10:45 AM

I know Dan Deacon is on at 6:30. Anyone have an idea of when Tom Tom club is scheduled? I would assume 7:15 or 7:30 if the show is so early.

Does the pool have a show curfew?

We're all Devo.
You may not keep up with Devo’s world tour over the last few years or the latest iTunes single “Watch Us Work It” but to take the side of a huge Corporation over the little guy. McDonald’s sued people named McDonald in Ireland for trademark violation and lost, they deserve to pay to use a copyrighted iconic look. American Idol helped to ruin pop music. If a problem comes along, you MUST whip it!
