Tony Iommi and Ozzy Osbourne

"It is with great regret that I had to resort to legal action against my long term partner, Tony Iommi, but after three years of trying to resolve this issue amicably, I feel I have no other recourse. As of the mid-1990's, after constant and numerous changes in band members, the brand of "Black Sabbath" was literally in the toilet and Tony Iommi (touring under the name Black Sabbath) was reduced to performing in clubs. Since 1997 when Geezer, Bill and myself rejoined the band, Black Sabbath has returned to its former glory as we headlined sold-out arenas and amphitheatres playing to upwards of 50,000 people at each show around the world. We worked collectively to restore credibility and bring dignity back to the name "Black Sabbath" which lead to the band being inducted into the UK and US Rock & Roll Hall of Fames in 2005 and 2006, respectively. Throughout the last 12 years, it was my management representatives who oversaw the marketing and quality control of the "Black Sabbath" brand through OZZFEST, touring, merchandising and album reissues. The name "Black Sabbath" now has a worldwide prestige and merchandising value that it would not have had by continuing on the road it was on prior to the 1997 reunion tour. Tony, I am so sorry it's had to get to this point by me having to take this action against you. I don't have the right to speak for Geezer and Bill, but I feel that morally and ethically the trademark should be owned by the four of us equally. I hope that by me taking this first step that it will ultimately end up that way. We've all worked too hard and long in our careers to allow you to sell merchandise that features all our faces, old Black Sabbath album covers and band logos, and then you tell us that you own the copyright. We're all in our 60's now. The Black Sabbath legacy should live on long after we have all gone. Please do the right thing." -Ozzy
According to the NY Post, "Osbourne is suing Iommi for a 50 percent interest in the 'Black Sabbath' trademark, along with a portion of Iommi's profits from use of the name", and claiming that "guitarist Tony Iommi illegally claimed sole ownership of the band's name, in a filing with the US Patent and Trademark Office. "

Meanwhile, Tony Iommi is currently touring with the rest of Black Sabbath (the Dio years) as Heaven and Hell. They hit NYC at the end of August.

Who would have ever thought that the man Ozzy denigrated as his replacement, calling him Ronnie "The Garden Gnome" Dio, would end up as the front man with the cred in the Sabbath story? Ozzy has become a zombified corporate puppet doing whatever he has to do to earn greedy Sharon more money to spend on whatever crap it is she spends it on. I was surprised that the the Sabbath II version (Heaven & Hell) would be as crackingly sharp and powerful as they are at this point, and Sharon is obviously in a snit that the Dio version of Sabbath is becoming THE version of Sabbath (under whatever name) for a whole new generation of hard rock and metal fans. It's not Dio or Tony Iommi's fault that Ozzy has blown his mystique and shredded his legend: it's his greedy, disgusting wife's. You should have finished her when you had the chance, Ozzy, because now she's finished you. Sharon got her revenge.

And Heaven and Hell does suck ass. It really is a shame to see the brand name Black Sabbath fall. Dio was an embarrassing mistake. He only added a gayness that can never be erased from the Sabbath legacy. Death to DIO and his god awful music!

Woke up late one night and couldn't sleep: flicked on the tube and they had Heaven & Hell on playing "I" (from Dehumanizer) live at Radio City Music Hall. The band sounded so good, Iommi so fiery on guitar and Dio so intense on vocals, that I immediately became a convert (I had always semi-avoided the Dio-led version of Sabbath out of some misplaced loyalty to Ozzy). This jolt woke me up and made me realize that these guys *without* Ozzy are still a sizzling outfit that deserves a large audience. So I hope it drives greedy, fame-starved Sharon even more crazy that it is Heaven & Hell with Ronnie James Dio singing that is the relevant metal band from that camp in this new millennium, while her husband, with much help from her, has become a sad, sad joke.

When people talk about sabbath they always go for the Ozzy Dio debate. But truth be told, the sound of sabbath is all about Tony Iommi. The vocals are a great compliment to the sound, in both cases and they both bring different things to the table.

But in the end this is just kind of sad.

Imagine if everyone who'd ever left a band still got royalties from that band? That's nuts!

plus if iommi actually holds a trademark then this is just going to end up costing ozzy a lot of money for nothing.

The Dio Sabbath may not be what people think of when they think of Black Sabbath, but its 75% of the band.
The Ozzy solo stuff is nothing too wonderful either with Bark at the Moon. So Ozzy almost left Sharon years ago? He must of had some close help writing that statement that he will regret I hope.
He was OK with the different version with Dio for 20 or more years. Not a good way to end so many years playing together to air this stirred up lawsuit against band mates in a odd, but well written statement.

Blizzard of Ozz was a good album, but anything with Jake E Less or Brad Gillis playing sucked. Bark at the Moon? Crappy album. I do like Zack's playing, but he still can't touch Iommi.

I like the way anyone who can actually sing is now labelled a "fag," as if cave man or cookie monster grunting is the only thing allowed for "real men" these days. So I guess Robert Plant, Ian Gillan, Glenn Danzig, and basically anyone with a singer's ability is a "fag" now as well. And Ozzy likes sappy ballads at least as much if not more than Dio: he's just not as good at singing them. Meanwhile, Iommi and company can keeping doing good music, and Ozzy can keep making a fool out of himself so Sharon can feed her celebrity addiction.

Second, Black Sabbath was great because of the song writing and originality for its time, which Ozzy had little if anything to do with. Third... HE WAS FIRED. Just listen to Technical Ecstasy and Never Say Die, and you'll know why he was, aside from that I guess he was partying to much for the rest of Sabbath to handle. With all the money, fame, good press, and endorsements that family has- don't you think it's a bit caddy to sue Iommi for rights and trademarking that Ozzy really doesn't need in the first place? Tony kept the band going for decades after Ozzy was fired. The last thing Ozzy did that was worth mentioning was Diary of a Madman, and again he probably thinks its all due to him... for sure not Randy Rhodes. Maybe him being dead is a good thing, because Sharon would probably sue him for something just as lame. I will continue to hold Black Sabbath as one of my favorite bands, but just let it be known, the music is what makes it, not Ozzy's trademark voice. When all is said and done, Ozzy is Ozzy because of Black Sabbath, and if you ask me, the prick should be paying royalties to Tony, Geezer and Bill because without them, the name Ozzy would only be synonymous with the former shortstop for the St. Louis Cardinals.

I dunno, the first time I heard Dio was him singing "Man On The Silver Mountain" by Rainbow, which still stands up as a pretty rocking tune. As I said earlier, I always avoided post-Ozzy Sabs out of some kind of loyalty to the Ozzman, but have come to realize that at this point, Dio is a better fit with Tony and Geezer than Ozzy would be. And Holy Diver *is* an 80s hard-rock classic. Ozzy can blame his celebrity-addicted, money-grubbing wife for what he has become today.
He had the chance to save himself and fell just short. He was so out of it when he tried to off her that he would have been out of jail long ago and still have a legend and a mystique intact. Instead, he's just a clown.

If anyone says that Dio's singing is crap & Ozzy's is great is tone deaf! The Ozzy Sabbath that Dio sang on Live Evil - blows what Ozzy did with it away!

And everyone knows - Black Sabbath is Tony Iommi. Tony & Bill started the band - and as far as I'm concerned - considering Bill doesn't want to do it anymore - then it's Tony's baby. He deserves sole ownership. Who kept it going through all the different singers in the 80's? Not Ozzy! But Tony!

And as far as I'm concerned - the Dio years allowed Tony to be more creative in his writing and his playing. He couldn't expand with Ozzy - because Ozzy's vocal range isn't that great.

And, I don't know about anyone else. The last time I saw an Ozzfest - Ozzy's voice cracked so bad - they had to play the vocal track from the recording of No More Tears to cover up Ozzy's voice. Even Zakk had to help, because Ozzy's voice was gone.

All the times I've ever seen Dio - I've never heard him crack once. And, he can still hit all the notes!

All you numb-nuts that talk crap about Dio - should go stick your head back in the sand!

Saw the Heaven and Hell show televised this weekend. The band is great, but I can't help but compare some of the signature tunes to the versions Dio did with his Last in Line era band. Vivian Campbell was ridiculous. When is that coming out on DVD????
