University of the Streets

Back on 9/9 we posted about an incident at NYC jazz venue University of the Streets where Kevin Shea of Talibam! ended up with a pretty nasty injury to his face after an altercation with the venue's staff. About a week later the venue did in fact respond.... all in caps and with some fun lines like this: "THE ATTENDANT RAISED HIS HAND TO PROTECT THE DIRECTOR AND IN THE MELEE THE BAND-MEMBER'S FACE CONNECTED WITH THE ATTENDEES HAND." STATEMENT OF THE EVENTS OF SEPTEMBER 7, 2011

TO WHOM IT MAY CONCERN:
TRUE ADVOCATES OF U.O.T.S. DESERVE AN ANSWER TO THE UNCONSCIONABLE DEFAMATION OF CHARACTER, AS WELL AS A TRUE REPRESENTATION OF THE COMPLETE FACTS AS THEY RELATE TO THE OCCURRENCES OF SEPTEMBER 7TH. THIS STATEMENT IS BEING MADE TO CLARIFY ANY MISCONCEPTIONS AND MISUNDERSTANDINGS THAT HAVE ARISEN OUT OF THE EVENTS, WHEN "TALIBAM" , THE BAND LEAD BY MATT MOTTELL AND KEVIN SHEA PRESENTED AT THEIR APPOINTED TIME TO PLAY AS PART OF OUR CURATED SERIES.
IT WAS NOTED BY THE EVENT ATTENDANT & UNIVERSITY OF THE STREETS (U.O.T.S.) EXECUTIVE DIRECTOR SAADIA SALAHUDDEEN THAT THE BAND HAD NO AUDIENCE MEMBERS ATTENDING THEIR CONCERT. AS IT IS CLEARLY STATED IN THE HOUSE RULES (BAND'S AGREEMENT) ALL BANDS SCHEDULED TO APPEAR AS PART OF THE CURATED SERIES GUARANTEE UNIVERSITY OF THE STREETS A MINIMUM OF FIFTY DOLLARS AND ARE ASKED IN CONJUNCTION WITH PROMOTIONAL EFFORTS MADE BY U.O.T.S., TO MAKE SINCERE EFFORT TO PROMOTE THEIR OWN CONCERTS FOR DUE TO COST CONSIDERATION U.O.T.S MUST MAKE SURE TO SECURE FIFTY DOLLARS TO COVER THE ONGOING EXPENSES OF PRESENTING BANDS TO COVER THE COSTS OF HEATING, A/C. ELECTRIC, PROMOTION AND THE ASSOCIATIVE COSTS OF PRESENTING CONCERTS.. AS IT WAS NOTED AT THIS SPECIFIC PERFORMANCE THE ATTENDANT (ONCE THE FACT THAT NO AUDIENCE WAS ATTENDING WAS ESTABLISHED), THE BAND WAS OFFERED THE OPPORTUNITY TO OPT OUT AND OWE U.O.T.S. NOTHING. THE BAND DECLINED THE OFFER, WITH FULL KNOWLEDGE THAT THEY WERE EXPECTED TO REMIT FIFTY DOLLARS TO U.O.T.S. AT THE END OF THE EVENING.
"TALIBAM'S" SET CONTINUED FOR THE ALLOTTED TIME PROVIDED FOR THE PERFORMANCE AND AT THE END THE ATTENDANT REQUESTED THAT THE BAND TENDER THE $50. TO COVER COSTS. U.O.T.S IS A COMMUNITY NOT-FOR-PROFIT AND AS SUCH HAS GUIDELINES BY WHICH IT WORKS WITH CURATORS, BANDS AND THEIR SUPPORTERS (VIA COMPS); GUIDELINES WHICH PROVIDE ALL MEMBERS, PERFORMERS AND THEIR ADVOCATES IN ADVANCE WITH AGREEMENTS AND CODES OF CONDUCT; GUIDELINES THAT PROVIDE AND REQUEST THAT BOTH THE ORGANIZATION AND ITS ADVOCATES TREAT ONE ANOTHER IN A COURTEOUS, SAFE AND CONSIDERATE MANNER. UNFORTUNATELY, ON THIS OCCASION, THE BAND BEING HOSTED DID NOT UPHOLD THESE STANDARDS.
UPON BEING REQUESTED TO TENDER THE CHARGES COVERING U.O.T.S. EXPENSES BAND-MEMBERS (INCLUSIVE OF MR. SHEA) FLIPPANTLY OFFERED IN A DISRESPECTFUL MANNER TO TENDER $10. AND WHEN ASKED TO ADHERE TO THEIR PRE-ARRANGED AGREEMENT BECAME INCREASINGLY BELLIGERENT AND DISRESPECTFUL TOWARDS BOTH THE U.O.T.S. PERFORMANCE ATTENDEE - AS WELL AS THE ORGANIZATIONS EXECUTIVE DIRECTOR. AFTER REFUSING TO PAY THE PRE-ARRANGED FEE BAND-MEMBERS BEGAN JUMPING ABOUT THE PERFORMANCE SPACE, HAPHAZARDLY TURNING UP P.A. AND AMPLIFYING EQUIPMENT TO EXCESSIVE LEVELS WHILE INCREASINGLY CHALLENGING AND DISRESPECTING THE ORGANIZATIONS STAFF. NOTING THAT THE ATMOSPHERE OF COOPERATION WAS DISINTEGRATING QUICKLY MS. SALAHUDDEEN REQUESTED THAT THE SPOKESMAN MR. SHEA LOWER HIS VOICE AND CEASE TALKING CRAZY - TO WHICH MR. SHEA RESPONDED THREATENINGLY - "YOU THINK WE'RE ACTING CRAZY - I AM CRAZY", "LET'S GET CRAZY" - I'LL SHOW YOU CRAZY" INCREASINGLY TAUNTING THE PERFORMANCE ATTENDANT WITH INSULTING REMARKS ABOUT HOW HE LOOKED & HIS APPEARANCE. THIS HAPPENED IN SUCH A DISCRIMINATORY AND COMBATIVE MANNER THAT THE SITUATION CONTINUED TO UNRAVEL SO MUCH SO THAT THE OCCURRENCE CULMINATED IN MR. SHEA'S LEAPING ACROSS THE PERFORMANCE SPACE IN A WAY THAT COULD NOT BE INTERPRETED IN ANY OTHER WAY THAN AS ONE WHICH WOULD RESULT IN BODILY HARM. MR. SHEA INVADED THE EXECUTIVE DIRECTORS PERSONAL SPACE IN A CLEARLY ILLEGAL AND ASSAULTING MANNER (WHILE GESTICULATING AND PHYSICALLY SUGGESTING HARM) WHILE SCREAMING "GO F... YOURSELF". NATURALLY, IN OBSERVING THIS OBSESSIVE AND COMBATIVE BEHAVIOR THE CONCERT ATTENDANT, WISHING TO CEASE FURTHER THREATENING BEHAVIOR, AND NOTING THE INFERRED BODILY HARM ABOUT TO OCCUR, THE ATTENDANT RAISED HIS HAND TO PROTECT THE DIRECTOR AND IN THE MELEE THE BAND-MEMBER'S FACE CONNECTED WITH THE ATTENDEES HAND. UNFORTUNATELY, BECAUSE MR. SHEA WAS WEARING NON-SAFETY TYPE SUNGLASSES, A SMALL INJURY OCCURRED WHEREIN MR. SHEA, ACCOMPANIED BY THE OTHER BAND-MEMBERS CALLED 911 AND ESCALATED THEIR ATTACK AND PUGILISTIC BEHAVIOR FURTHER INSULTING IN A DISCRIMINATORY AND DEGRADING MANNER, THE ATTENDEE. - WHOSE ONLY WISH WAS TO PROTECT THE EXECUTIVE DIRECTOR (MS. SALAHUDDEEN WHO IS A GENTLE, WELL-RESPECTED COMMUNITY LEADER AND INTELLIGENT WOMAN) FROM FURTHER ABUSE AND HARM
U.O.T.S. IS PROVIDING THIS ACCURATE ACCOUNT OF THE EVENTS OF THE NIGHT AND PERFORMANCE OF "TALIBAM" ON SEPTEMBER 7TH, AS A FAIR, ACCURATE AND CLEAR RECOUNTING OF THE EVENT AS IT OCCURRED. NEITHER U.O.T.S. NOR ITS EXECUTIVE DIRECTOR SUPPORT, ENCOURAGE OR ADVOCATE FOR VIOLENCE OR DISRESPECTFUL BEHAVIORS OF ANY SHAPE OR FORM. These guys draw people (both in New York and around the world). It's not the most popular venue to attend in the first place of fans of the genre these guys are in.

The venue didn't even have the show on their facebook page or twitter... not saying that's going to make ANY difference, but when the venue itself can't do something as simple as put the damn show on their calender, they are idiots.

Has anything happened at the venue since this incident? The October curator moved all events to another venue. There is an entire circle of musicians that will never play there again.

Well, since UOTS isn't making their 50 dollars a night if the bands scheduled now don't show up, yeah that will put a dent in them. Apparently they need that 50 bucks SOOOO much they are willing to assault people over it.

Also, are they a REAL non-profit?? or are they just saying that to get out of stuff. If they are real, i'd like to see their financial/annual report, they should be available on their website if they are.

Sounds like a ridiculous situation all the way around.

a losing proposition to begin with and end with.

What was the point of even playing the show? What was the point of booking it?

Why would the band play for no one, and why would the venue assault someone physically over said band forking over fifty bucks to cover expenses. Seems to me that everyone associated with this here event was crazy.

That sounds to me like it should have been cancelled.

and if the band decided to play anyway they should have forked over the money as they would have had to pay for that time at a rehearsal studio where there are also no audience members

Seems like the band is chiming in throughout this thread trying to justify themselves and their problematic public image. To the "we pack the house in NYC and Europe alike" claim . . . whatever. No one cares about Talibam and their agitprop improv at this point. Kevin Shea has been riding this same agit-prop vibe since his days in Storm and Stress. His shit is tired and the band clearly needs to decide whether they want to do fashion shoots or be part of the aging "downtown" improv scene. Both options seem pretty lame to me.

^wasn't Don Cab pretty much considered the worst behaved indie rock bands of the '90s? I'm sure plenty of people took swings at those guys.

i understand they have bills. I work for a non-profit. I'm questioning whether or not they have made their financials public record.

Kevin played in Storm and Stress with Ian from don cab/battles. That is it. Nobody in this band was EVER in don cab.

I generally don't side w Douchebags, but I don't find the above story of events the least bit believable as related by SS. notice how SS claims that because of KS's "leaping" about
"talking crazy" and being "disrespectful" his face made contact w SS's hand. He conveniently omits hitting Shea w a closed fist which held some type of improvised weapon- ie a large key ring or possibly brass knuckles.

Further what kind of asshole loses his shit over $ 50? And who can say that the band would not have reimbursed the venue within a reasonable amount of time.

Maybe there were words, bad blood, whatever prior to the incident. Losers all around, but if Shea didn't put his hands on anyone than he should sue these cunts. non profit does not mean you can act with impunity.

And yes as stated unfortunately, but very true sadly since they were\are good musicians,
Don Caballero had fat ego attitudes which makes me shake my head when people get a little too riled up about Battles. Ian (silly mustache) is pretty stuck on himself and Damon Che has pissed off many clubs with his attitude. Damon still uses the band name. Thats odd.

Sadly there was more than a few bands in Chicago in that same scene that needed to get slapped hard for their ego.

I see these rich white kids on the LES all of the time. They act like they own the place. They were raised by their rich parents to act like ass holes. They have no respect for anyone. These guys are most likely frat boys with guitars.

But I would say to any band playing these types of places, don't play at them. When a venue asks for money to play it's not a real venue. It's a messed up way to make money.

Plus if this "contract" isn't on paper it doesn't exist.

No matter if the audience is empty. The band should play. sometimes it's not about money. Greedy people will act up when the money is in question. The money will come if money isn't the goal. Do you think Barry Harris's first goal is money??? I don't think so. The love of sharing music
is his goal.
My suggestion to "UNIVERSITY OF THE STREET" is, get a professional staff to help Saadia run the institute and not a hot headed son.
