Defeated Sanity at the old Silent Barn, 2011 (more by Samantha Marble)

While Silent Barn moved to a new location at the start of the year, the original space (915 Wyckoff) is being reopened by Todd P:

A NEW VENUE IN THE FORMER SILENT BARN SPACE - an all ages venue + art studio space on the Bushwick/Ridgewood border

The former Silent Barn space on Wyckoff Ave will re-open as an all ages music venue for "new music" (aka noise, avant composition, artistic rock, etc) - with a (licensed) bar for the grown-ups, as well as on-site creative office space and artists' studio space. It will double as a neighborhood bar on nights without shows, and a gallery, plus a separate gallery and show space in the basement to open at a later date.

There seems to be some confusion as to why this is happening, and how, so here is the tale: apologies it's a long story...

There's no word on when the new incarnation of the space will reopen, but the rest of the long story continues below.

In July 2011, the original location of the Silent Barn was forcibly shutdown in a joint raid by the NYPD, the FDNY, the Department of Buildings, and the Department of Health; and its residents were thrown out in the street. I was not involved in the Silent Barn at the time (I had been a member starting in 2007 but I had gradually dropped out and then formally quit and stopped paying rent, in a cordial understanding with the "Barn Dudes" about a year before, when I found out I was going to be a dad). I was soon surprised to learn that the guys who ran the place had never got around to signing their own lease (out of bumbling benevolent flakiness, presumably), and that my name was on the last (expired) lease on the building. I'm told that I would have had to have evicted the guys and thrown them out in order to have indisputably cleared my name off the lease beyond question, since they hadn't signed their own.

This has become an issue because (for reasons unknown), the Silent Barn guys have neglected for two years now to step forward and assert on paper that I wasn't involved when they were raided. The situation has left me and my family potentially exposed to some serious financial liability, and put me in a complicated place with that building's landlord - from whom I happen to rent another building. I have found myself in a Kafka-esque position, forced to defend myself from a lawsuit about a building that wasn't mine, for missteps that weren't my own, from a building landlord who himself was cited and severely fined for major Fire Department and Building violations simply for unwittingly owning a building where tenants ran an "illegal nightclub" and lived in "illegal" residential apartments under his nose; plus more liability for lost rent because the guys stopped paying for months then allegedly broke lease without notice. As you can imagine, it has been a messy situation.

Adding perceived insult to injury, the owner initially defended the dudes and spent money financing the beginnings of a legal defense for the Silent Barn guys and their former space, and had retained an architect to help them re-open it - just before they bailed. In October of 2011, the Silent Barn guys left suddenly upon learning from that architect that, though the building could be legalized to host shows again, it could never be a loft they could live in again. A few months later the landlord approached me with a simple deal: since he'd already paid for it, what if he continued to finance "legalizing" the space and could get the building's problems resolved; would I agree to come back then as a tenant at the same rent we paid in 2007, with nobody living there but otherwise no other strings attached?

It was a very good offer and it was being offered by a man who had a real grievance against guys I had introduced him to, and whom I rent from in another building - it was an offer I couldn't comfortably refuse. It was also a clear way to make another good all ages venue exist in the scene. It's now two years later, the Silent Barn guys are thriving in their own new space, and I have a new lease on that old familiar space off the L train, with legal certificate-of-occupancy and other paperwork baked into the deal. We haven't settled on a name yet but I can tell you that it won't be called "the Silent Barn"! haha

I think I saw the crew who robbed the Silent Barn a couple of years ago. Four guys pull up in an old shit wagon and start packing up all kinds of speakers and gear and stuff. One guy had dreadlocks, 2 others were wearing doo-rags and the 4th guy looked like he was wearing no pants, just boxers.

It is the responsibility of the person leaving a lease to make sure their name is adequately removed from that lease – and it is the responsibility of the landlord to then ensure that they have a current accounting of the proper lease-holders. Saying otherwise is a deliberate misstatement of fact. Todd is a lying piece of shit.

It's curious how he opens a new "DIY" venue in a space from whose previous DIY venue tenants were ousted.

I don't think it would be extraordinary or unreasonable to say Silent Barn was ousted so Todd P could take over the space. SB is shut down in 2011 and Todd opens a new space there in late 2013/early 2014, how convenient. I mean why is he badmouthing his SB partners years after the shut down and how come he was silent (no pun intended) about the SB guys after it was announced that SB was shut down and during their Kickstarter campaign? You got a new venue, the SB guys moved on and got a new venue, so why bark about what I'd imagine is water under the bridge? Why make the private public? I mean is whatever between Todd and the SB guys the business of anyone outside of them? I don't think so.

What does a new venue in the SB space have to do with the SB i.e. why talk about what went down at the SB when you're opening a new venue in the space? This guy comes off like someone who conspired with the building owner and cops to oust SB so he could open yet another "DIY" space only he could control (he's the farm system for Bowery Presents, nothing more, nothing less BTW.) Again, shut down SB in 2011, wait two years, then open up a new place there.

Fuck this guy for not saying it'll be for hardcore punk shows, too. Hey Todd you don't do shows or have a DIY space without hardcore punk, so show some respect moreover support to a scene and music without which you and your fellow hipsters don't exist.

todd fucked himself by not getting himself taken off the lease when he left. the consequences of his sloppiness suck (getting a space WAY below the current value BOOHOO!!!), but they are his and his alone. in a weird twist, it is likely that the only reason NYPD and FDNY/DoB raided the place was Todd's name on the lease. but SB's slum-landlord was concocting reasons to evict them long before the place got busted. that lease was nullified when they were barred from entering their own living space - and it was an illegal lease at that, completely unenforceable in any court of law. so how todd claims he is being held to it 2 years after the order to vacate is extremely dubious to anyone who has any knowledge of NYC tenant law. but i have never known todd to be honest about anything. there are several layers of lies here, it's not worth anyone's time sorting out. unless you want to pay me $500/hour.

1. @2:46 Staten Island will never be the next "it" borough. EVER. I lived there in my teenage years. it's a bottomless pit of waste and there's only 7 people there worth talking to, maybe 8.

2. D is a fucking IDIOT.

3. @6:31 Todd never had anything to do with Fitness. I've never been there before but it seems like a hellhole.

4. @1:56 He's not poor, but he's not rich. he's middle class, i would say. Most of his money is probably going towards his kid now anyway or throwing more festivals in Mexico.

5. I used to bartend and work the door at Silent Barn in 2010 up until it got raided and shut it's doors (which was not a conspiracy by the way, it really did happen. no one was home at the time.). I never made over 20 bucks working there, but it had a nice vibe to it. The promoters always bought you an entire pepperoni pizza whenever you worked which was always a HUGE plus. There was a Sega Genesis with a ton of games and an entire shelf filled with comics and zines to read while working, because the place was always empty. It was empty because the shows being booked there were piss poor quite honestly, not unlike the new Silent Barn unfortunately. Just a bunch of evil hipster noise crap. I'll sometimes float over to the new Silent Barn but only if they have a decent band playing like Blanche Blanche Blanche or Swearin'. I think it's a good idea to have Todd P back running the space. I've seen what he's done with the place and it looks nice. When I was in high school, I saw Silver Apples there (back when this venue was his main operation) and made out with some girls and even got punched in the face by some bro in flip flops. Good times. I hope stuff like that will happen again in the future.

6:21 actually yes, the back and forth is public info, and on a very factual, legal record... unlike the lease in this case which was negotiated but neither signed nor notarized.

If i were on the chopping block... i'd read up on tenant laws, file bankruptcy and tell the landlord toma.

9:36 I don't think that's actually true. No one has disputed the timeline. The argument hasn't been made very clearly, but what's being said to counter Todd P is that since the Silent Barn boys happened to have not gotten their shit together enough to have signed a lease by the time they got shut down by the city of New York, that they can't be held accountable technically speaking for the things the city hit them for (being an illegal night club, selling alcohol with no license, not following fire code, living there illegally) and that it's therefor okay for them to shirk their responsibilities and to deflect the punishment consequences of what they got caught doing onto Todd P (because he had a lease there years before and didn't evict them before this all happened) and the building owner (because all landlords suck, or something).

it's pretty ironic because milking that kind of legal technicalities to get out of what is obviously your own responsibility, and letting it all fall onto somebody who totally wasn't involved, is pretty much usually the way the bad guys and their evil lawyers behave when you hear these kinds of stories. And you'd think the "DIY" guys would be the ethical ones, doing what's right and not fucking over other people...

^^ These are things Todd P not only endorses but trains people ito do (including SB in the past) and he follows this lifestyle himself, as a means to make money off of young people. It's a miracle he hasn't been jailed for the sheer amount of alcohol he has been selling to minors.

As far as "good guys and bad guys go" if you want to simplify it that way 5:44 - The landlord is a wealthy LLC probably not hurting for cash. Todd P is a club owner selling beer to 18 year olds. Silent Barn is pretty much just a civic center and alternative art space. This is a fantastic example of the American tradition of the wealth class undercutting the weak market for capital gain. Get the fuck off Brooklyn Vegan and go read some books.

Talk about milking the law. Take a look at this landlord with no signed lease trying to get back payment.

But I'm sure everyone else LOVES their landlords and would TOTES pay them all the money they JUSTLY deserve in a case like this, am i right guys?

There's much that's disingenuous in 5:09's argument.

The core group of boy-children who run the Silent Barn were the only people running, and profiting from, their former space when they ran into trouble and got shut down by the City. They sold booze illegally constantly at all their shows (whether that's a bad thing or whether it's no big deal, it IS a fact) and they were the only ones booking concerts and living in a space that wasn't licensed for either thing. They were the only ones making money illegally there when this happenened, not Todd P or anybody else.

Saying it's ok for them to shoulder the consequences of what befell them unto Todd P is a bit like saying Todd P gave them his old bicycle, then a year later one of them got a ticket for riding the bike on the sidewalk. They remember seeing Todd ride bikes on the sidewalk in the past... so they think it's ok for them to let Todd P get the ticket instead of them, and so it's of for them to actually lie about the identity of who was riding when the cops caught them so Todd P takes the fall instead.

Onto 5:09's next little lie haha : Alcohol selling to minors. Both Todd P and the Silent Barn do all ages shows where alcohol is sold. If that's reason enough to say a place "sells to underage kids" then the Silent Barn is guilty.

There's zero indication that Todd P or the Silent Barn guys purposefully sell booze to anyone underage, and a lot of evidence that they all try very hard to make sure it doesn't happen. After all underage drinking would be a surefire way to get shut down quickly. One thing that anyone can agree on is that Todd P has persisted, and for years, running pretty high profile shows that are all ages and have booze for sale. None of that means he sells to minors, anymore than it means the Silent Barn sells to minors. In fact, if you've ever been to 285 Kent or the old Market Hotel they always card you at the door. They don't send kids away if they're underage but they mark them and identify them too young to drink.

This is not something that happens at all the all ages spots mind you, and many of them are famous for selling drinks to minors. Not Todd P's spaces. In fact, the old Silent Barn under the reign of the boys who had it when it got shut down was famous for selling booze without carding. It wasn't a very well known problem because their shows never had large numbers of anyone at them, same as their current space, which also doesn't card consistently yet sells beer and is all ages.

What makes Silent Barn a civic center? It has shows and sells booze and it isn't a not-for-profit. they have a lot of volunteers, but how is that different from any other unpaid internship? The place is a bar. Same as any other club except for the fact that it's usually poorly attended. It's a commercial venture where they are not only selling alcohol but they are also subleasing every inch of their property to other people and taking in more money then they pay in rent. That's not a charity by any definition.

As for landlords, 5:09 just expects everybody reading this to kneejerk hate the landlord because he might be rich and because he's a landlord. But aren't the Silent Barn guys themselves renting out every inch of their space, at a profit? That's the definition of a landlord. Something tells me that if one of the Silent Barn's own subtenants caused a huge legal problem on their property that they themselves wouldn't be so sympathetic about the "landlord" (or some random guy who rented the space before they did) taking all the fall for what happened.

you mean the wealth class, like Joe Ahearn who who grew up in Tribeca and who's parents are a famous millionaire film director and painter?

or Kunal Gupta who never ever seems to hold down a job and who's over 30 and still living off his millionaire Connecticut financier family paying for his life?

These guys get a lot of slack for pretending to be a charity, but they're really just rich kids who can afford to own a for profit biz that can't seem to make money
