Prince

Prince has long been known for not liking others to take what's his -- even if that means taking a photo of him or covering one of his songs. He's just sued 22 Facebook users and Google Blogger account-holders for $1 million each, claiming they "engage in massive infringement and bootlegging of Prince's material." The Lawsuit names Dan Chodera, Karina Jindrova, and 20 other anonymous defendants. Reports SPIN:

Prince asks for a jury trial, which, though highly unlikely, would have to make for some fascinating courtroom drama. In addition to the $22 million total in damages, Prince wants the defendants permanently blocked from infringing on his copyrights. He also wants them to forfeit any money they may have made from his music -- with interest -- and to return any "unlawful materials" to their rightful Purple custody.
In other news, Prince is planning a series of London concerts which he's announcing on February 3.

The day before that press conference, the usually camera-shy Prince will appear an episode of FOX sitcom The New Girl that will air directly after the Super Bowl (2/2). You can watch a trailer for that below.

Reading the complaint, its pretty obvious that these are fan sites (blogger, facebook, etc) and they're trading non-commercial live recordings of Prince almost certainly without the exchange of any money.

It will be interesting to see how this plays out because its clear that the person who wrote this complaint doesn't understand the non-commercial nature of fan-to-fan trading, the concept that without fan recordings, these shows would otherwise never be heard after the performance, and the fact that no fan makes any money from the recordings and Prince suffers no damages.

I think its pretty clear that there is copyright infringement, but its equally clear that there's no illicit economic gain and no financial loss to the artist.

As a public relations move, though, its not entirely clear what Prince has to gain by going after what are probably his most fervent fans -- the ones that already own all of the official material and can't get enough so they download all of the unofficial stuff. Its bad PR and probably hurts his bottom line.

If I were a defendant, I'd send him a bill, with interest of my hosting charges, equipment cost and ticket prices.

99% of the people who put shit on the internet for free are paying for it. All of it. No money's coming in. Especially not a million bucks. I'd totally take it to court, make them prove damage and show me where the money came in.

Wow - this is a really bad move on Prince's part.
Most of these defendeants are the real hard-core Prince fans and I seriously doubt that any of them are making any financial gain off of their sites or blogs.
Doesnt Prince understand that these are the things that help promote his music?

I was a Prince fan but if he continues this campaign against his real fans - Im done with him!

Jerry Garcia once famously said that about 2 seconds after the Dead played a note they no longer had any use for it, and because of this they encouraged fans to tape their shows.
